Complaint #33992 — S Raghavendran

Filed: 25 Dec 2023  ·  Address: 18/51, 1 Floor, 1 Main, Maruti Extension, Bangalore 560021
I purchased a pair of shoes for Rs 2999 from Bata India Ltd., 1115 Sampige Road, Malleswaram Bangalore (Full company name is not mentioned in the bill) vide their invoice no CM104230023848 on 26.11.2023. I am charged an additionally Rs 6 for providing a paper carry bag. By providing the carry bag against extra charges, Bata India Ltd is deficient in providing due service and also indulged into unfair trade practice. One cannot be expected to take the goods/garments purchased in hands. I am shocked to see the kind of services provided by MNCs like Bata. On one side they offer huge discounts of up-to 70% on the products and on the other hand, they are charging for a carry bag and could not give it free of cost to its worthy consumers. Rule 15 of Plastic Waste (Management and Handling) Rules, 2016 which permitted retailers to charge for carry bags has been omitted vide Notification dated 27.03.2018. Therefore charging for paper carry bags is totally against law and against consumerism State Consumer Disputes Redressal Commission, U.T Chandigarh has already held the act of charging for a paper bag to be an act of unfair trade practice and has made this very same Bata to compensate a consumer, pay litigation charges and levied punitive damages. I therefore request this commission to pass orders that Bata India Ltd pay the charges of Rs 6 plus compensate me for my time, mental and physical harassment and levy punitive damages in the form of payment to Legal AId Account of the State. consumerism. Thanking you in advance.
